CNNMoney.com has often sounded the warning that timeshares are a trap. In one article, Bill Rogers, of Timeshare Users Group, said, &#8220;You don&#8217;t buy a timeshare as an investment. You buy it because you want to use it.&#8221; The article also reminds us the price of timeshares are grossly inflated 35-45% to cover all the hype that goes into getting people to buy them in the first place. Once timeshare owners realize their mistake and try to sell their property they discover a hard truth &#8211; unlike other real estate, timeshares lose value rather than gain it over time.</p>

ORLANDO, FL – March 1, 2011</p>
<p>Florida attorney, Susan Budowski, a timeshare victim advocate, warns consumers to be aware that with the resurgence of the timeshare industry,timeshare scams will rise with it. According to Howard Nusbaum, President of the American Resort Development Association, a pro timeshare industry association, &#8220;the travel and timeshare industry is seeing a resurgence of travel in 2011, terrific news for the timeshare industry.&#8221; Attorney Budowski warns consumers this also brings more victims of deceptive sales practices by unscrupulous sales representatives.</p>
<p>Budowski adds, &#8220;unfortunately many timeshare owners are getting taken advantage of multiple times. I have seen those who have been misled or coerced into buying a timeshare and then later desperate to get out of their contract, attempt to sell their timeshare only to be taken advantage of by a resale company.&#8221; Evidenced by a recent SWAT team raid of a purported timeshare resale company, Orlando Police Department&#8217;s SWAT team raided an illegal timeshare resale telemarketing operation. A spokesman for the Orlando Police Department said &#8220;the company was taking two to four thousand dollars per customer without providing any services. The raid and arrests were a result of timeshare owners from Florida to Canada filing multiple complaints.&#8221;</p>
<p>Attorney Budowski advises timeshare owners that feel they have been a victim of a resale scam, to contact their local authorities. She adds, &#8220;the majority of legitimate real estate transactions do not require an upfront fee to try to sell or rent a property, if a company does, that should raise a huge red flag&#8221;.</p>
<p>Budowski also warns of a surge in timeshare cancellation companies on the Internet and utilizing similar unscrupulous telemarketing firms to take advantage of timeshare owner&#8217;s misfortunes. &#8220;These companies make false claims of legal expertise and claim to guarantee refunds and or cancellations of timeshares and like the resale companies, require an upfront fee, many times exceeding what it would cost to hire an attorney.&#8221;</p>
<p>Budowski further conveys, she understands many people are reluctant to get a lawyer involved, however when dealing with a timeshare company on a matter like misrepresentation, deceptive trade practices or coercion in a timeshare sales contract, she believes it is imperative to be represented by an attorney, whether her firm or another law firm. &#8220;Consumers need to recognize that some of their contract documents are hundreds of pages and that the timeshare company spent tens of thousands of dollars drafting them, and certainly not on the purchaser&#8217;s behalf. Not to mention, they have lawyers that work directly for them as well as an outside law firm on retainer.&#8221; While there are some do it yourself document services for basic legal issues that work, this is far from a basic legal matter.&#8221; She adds, “this is one battle you definitely want a lawyer on your side of the table.&#8221;</p>
<p>&#8220;If you feel you were taken advantage of by your timeshare sales representative and pressured to sign a contract, I recommend only working with a licensed attorney who specializes in these matters. They will assess your situation to determine what legal remedies you may have. Then, if it warrants canceling your timeshare contract, he or she will take the proper steps to make sure your situation is properly handled. Until then, don’t try to cancel your timeshare or sign a timeshare cancellation contract with anyone or a firm that is not a licensed attorney to represent you&#8221;, Budowski said.</p>

The ownership will be specific on how many weeks the owner owns and from which weeks the owner may select for the owner&#8217;s stay. An example of this may be a floating summer week where the owner may request any week during the summer season generally weeks 22 through 36. In this example there would be competition for prime holidays such as the weeks of Memorial Day, Fourth of July and Labor Day. The weeks when schools may still be in session would not be so high in demand. Some floating contracts exclude major holidays so they may be sold as fixed weeks.</p>
<p>Floating weeks still confine you to within a specified period of time, say the summer time, but at least afford you the luxury of changing things up if you can&#8217;t get a certain week off at work or need to alter plans to get the entire family down.. this is a great alternative, but with convenience comes expense.</p>

An owner may own a deed to use a unit for a single specified week. For example, week 26 normally includes the Fourth of July holiday, week 51, Christmas and so on. If an owner owned Week 26 at a resort he or she could use that week every year.</p>
<p>Fix week is great if you know that your going to be free on that date forever, like if your a school teacher and that is a permanent vacation day or something, otherwise, fix week can get lost due to non-use. That&#8217;s right, if you don&#8217;t use it, you lose it, and you still have to pay the resort fees for that week&#8230; This is why so many resort timeshares are for rent on VRBO.com, Homeaway.com and VacationRentals.com &#8211; they need to fill it or else they lose the annual fees. </p>
<p>You can avoid this by getting a floating week timeshare.</p>
